HC quashes Annulment order on Basavaraju’s Appointment

Mysore: The contentious post of the Registrar of the University of Mysore is again under the scanner, with the High Court of Karnataka issuing an order to reinstate C Basavaraju.

A High Court order, in response to a writ petition filed by Basavaraju, has quashed a Government order annulling his appointment. “Consequently, the petitioner shall be restored to the post of Registrar, University of Mysore,” the order dated June 13 said. “However, it is clarified that it would be open for the Government to take decision, which may be permissible under law and this order would not come in its way,” the order further stated.

Basavaraju was among those appointed in the year 2006-07. There was a hue and cry over the appointments made during the year, and a one-man commission of retired judge H Rangavittalachar had observed that there were several ‘irregularities’ and ‘procedural lapses’ regarding the appointments.  Basavaraju’s appointment as Registrar was annulled on March 29, 2014.

The University of Mysore on Monday deferred the decision to declare over the probationary period of the teaching staffs whose appointment has been ordered to be cancelled by the state government.

In all 135 teaching staffs appointment has been ordered to be annulled by the government in its June 18 order. The order reached the varsity on Monday just before the meeting of the Syndicate was to commence. The meeting of the apex body of the varsity had on its agenda declaration of the probationary period of the staff following a directive from the high court. Caught in Catch 22 situation, the Syndicate decided to defer the decision to declare probationary period and also to approach both the government and the court.
