Bangalore:High Court disqualified the private petition filed by JDS spokesperson MLA Y S V Datta, inthe case registered against BSY for irregularities in the Upper Bhadra irrigation project.
On Wednesday, Justice K.N. Keshavanarayana quashed a private complaint lodged by Janata Dal (S) leader and legislator Y.S.V. Datta, alleging that Dhavalagiri Properties and Sahyadri Health Care Ltd – owned by Yeddyurappas sons B.Y. Raghavendra and B.Y. Vijayendra and son-in-law R.N. Sohan Kumar – received kickbacks of Rs. 13 crore from Murudeshwara Power Corporation Ltd, a sister concern of a joint venture forged by RNS Infrastructure Ltd and Jyothi Limited, immediately after the Rs. 1, 033 crore-second stage of the Upper Bhadra irrigation project was awarded to the joint venture.
The judge struck down the case on grounds that the complainant had not obtained prior sanction from the competent authority.
Coincidentally, sources in BJP said the partys top brass has decided to seek legal opinion on corruption cases pending against Yeddyurappa before approving his return in order to save embarrassment in future. The top leaders were wary of criticism by Congress leaders if they chose to ignore the cases and reinduct the former chief minister.
The sources said though the leaders were wary of cases pending against Yeddyurappa, they were concerned about one case in particular, for which he has been chargesheeted by the Central Bureau of Investigation (CBI) for allegedly receiving a kickback from a mining firm through the Prerana trust, owned by his kin
