Former Madras judge blames state legal team for Cauvery verdict against Karnataka

Mysuru: Retired judge of the High Court of Karnataka and the High Court of Madras C Shivappa from Mandya has blamed the legal team of the state government for failing to present the ground realities in terms of availability of Cauvery water before the Supreme Court.

In a press conference, the retired judge, said, “I believe, what the Supreme Court has given is a directive and not an order because, as reported in sections of media, there is no reference to the rival contentions of the parties with reference to materials placed, if any, regarding ground realities and reasons thereof.”

Shivappa, had served as an Advocate-General of Karnataka during the tenure of S. Bangarappa as Chief Minister before his elevation as the judge of the High Court of Karnataka.

He further added that the state government which submitted an affidavit to the Supreme Court in April this year, offering to release 10,000 cusecs of water, failed to submit a fresh application withdrawing its offer when the rains failed. “There was more than three months time to move the court and the Supreme Court had no jurisdiction over the Cauvery water dispute between Karnataka and Tamil Nadu as Parliament, under Article 262 (2) of the Constitution, enacted the Inter-State River Water Disputes Act in 1956,” he said.
