Unauthorized Development Regularization Rules Approved

Bangalore: The Chief Minister Siddaramaiah has, during a meeting held on Tuesday May 20, given his approval to implement the Karnataka Town and Country Planning (Regulation of Unauthorised Development and Constructions) Rules 2013 scheme.

The scheme is designed to regularize building by-law violations and land use in urban areas across the State.

A notification to give effect to the scheme will be issued in a week’s time by the Urban Development Department officials, sources said.

The implementation of the scheme had been delayed as the model code of conduct was in force due to the Lok Sabha polls. The scheme seeks to regularize up to 50 percent violation of setback norms and permissible floor area ratio in residential buildings and up to 25 percent in non-residential buildings in all urban areas.

As per rules, up to 25 percent violation in residential buildings will attract a fee of 6 percent of the total guidance value of the property.  For violations between 25 and 50 percent, a fee of 8 percent of the guidance value has been fixed.

The rules stipulate that an applicant desiring to get his unauthorized development regularized should submit the title document, ‘Khata’, survey sketch from the Revenue department, site plan showing details of the surroundings and photograph of construction (from different sides showing all external details of development).

The rules for the scheme have been framed in accordance with the directions of the Karnataka High Court.
