K’taka HC directs state govt to revisit Tipu Jayanti issue

Bengaluru: The Karnataka High Court has directed the state government to revisit its decision to ban Tipu Jayanti on Wednesday, November 6.

Taking into consideration the Public Interest Litigation (PIL) filed by Bilal Ali Shah, Sultan United Front and Tipu Rashtriya Seva Sangha against the government’s decision to ban Tipu Jayanti, the division bench, led by Justice A S Oka, began the case proceedings.

During the hearing, the court said that as the matter is of public interest, no decision should be taken with immediate effect.

Rejecting the arguments made by the state government that the celebration of Tipu Jayanti would affect the law and order of society, the bench said, “There are a lot of hurdles while celebrating Kannada Rajyotsava too. It does not mean that there is a law and order issue and the court cannot accept that argument. The court can accept the argument only if it is related to government policies. The court cannot accept everything and anything the government says. The government must re-look into the matter.”

The court also directed the state government to maintain law and order on November 10 (Tipu Jayanti).

Advocate General, fighting the case for the government, informed the court that the government would not impose restrictions on private celebrations.

Meanwhile, the court has decided to pronounce its final hearing on January 20, 2020.
