Bengaluru: The High Court quashed the First Information Report (FIR) registered by Bantwal town police against 13 persons including RSS leader Kalladka Prabhakar Bhat, MP Nalin Kumar Kateel and opposition leader in the state legislative council Kota Shrinivasa Pujari in connection with the protest in Bantwal town violating the prohibitory orders issued under the section 144 of IPC at the time of RSS activist Sharath Madiwala’s murder.
Advocate Arun Shyam argued for these 13 persons.
Justice Ashok G Nijagannanavr quashed the FIR after upholding the argument made by the advocate for the accused.
Advocate Arun Shyam argued that holding protest is the fundamental right of Indian citizens. “In this case, the DC should have registered case. Instead, Bantwal police registered Suo Motto case. It is the clear violation of law,” he argued.
Justice Justice Ashok G Nijagannanavr upholding the argument quashed the FIR.
