Bengaluru: The Supreme Court of India today issued Notice to Sri.Ashok Kheny MLA of Bidar South Assembly constituency in a Special Leave Petition No.1471 of 2015 filed by Abraham T.J against the dismissal of the Election Petition No.12 of 2013 by the Hon’ble High Court of Karnataka on 05-09-2014. The Election Petition 12 of 2013 was filed before the Hon’ble High Court of Karnataka for disqualifying Ashok Kheny, MLA of Bidar South, for not being a citizen of India as he had obtained a citizenship of the US and also that he was not a Voter in the Electoral Roll of Bidar South.
The Supreme Court held that a single Judge of the High Court cannot overrule and reverse the Orders of another single judge of the same High Court. Hich could only be done by the Supreme Court of India.
The Hon’ble Supreme Court took note of this aspect and issued Notice to Ashok Kheny today.
The Three Judges Bench was headed by Chief Justice along with Justice Arun Mishra and Justice Amitava Roy.
