Karnataka Elections: Go for floor test on Saturday, says SC

Bengaluru: The Supreme Court has asked the BS Yeddyurappa government to take a floor test on Saturday and prove its majority.

A bench of three judges, hearing a joint petition filed by the JD(S) and the Congress challenging Governor Vajubhai Vala’s decision inviting Yeddyurappa to form a new government in the state despite having 104 MLAs — eight short of simple majority has offered two alternatives to Yeddyurappa government. Accordingly Yedyyurappa will either have to prove his majority by taking the floor test on Saturday at 4 pm or opt for a detailed arguments on governor’s decision in the court.

Attorney General MukuL Rohtagi, counsel for BJP had in his argument said that there had been no pre-poll alliance between the Congress and the JD(S). The BJP as a single largest party should thus be given the chance to form the government. He also produced the letter presented to Governor Vala by Yeddyurappa, which claims that he has the necessary support of MLAs and can prove majoriity on the floor of the House.

However counsel for Congress, Abhishek Manu Singhvi argued that the Court must decide who is entitled to get the first chance to form the government.

Contending that the floor test is the best alternative at the moment the SC bench said that the larger question on the law on how should a Governor invite a person to form the government can be settled later in court

Meanwhile the Congress has agreed to go in for a floor test tomorrow.
